How is all the garbage not burying us alive by now? Just think of all the garbage generated by major cities every single day. It's surreal to think how this civilization could even last a week, with so many people disposing of and using so much frigging stuff.
Yes, a lot of the first world off loads its garbage onto the third world and these developing countries, in turn, generate just as much of their own garbage. Garbage that usually ends up in toxic/illegal landfills, into various waterways, or floating out into the ocean only to become a part of the humongous island garbage patches dotted around the globe. In my case, nothing served as a more startling example of the waste we collectively generate than the local city dump. Occasionally, to get rid of old furniture and other random stuff, we've made trips to such a place as this, which allows you to drop off old junk in a giant dumping ground for a small fee. Even for the modest town I live in, this local dump, which is privately ran and is only one out of a couple for this area, has always had a literal mountain of garbage tens of feet high, by tens of feet long. It's sheltered in a very large half-open warehouse and there's always so much garbage there that it's practically touching the ceiling high above. And yet this is a normal amount of garbage collection for them. One that replicates itself week after week without fail. And they're not even the official dump for the city, which means that massive amount of garbage I've seen constitutes only a fraction of that actually generated by this city. And then, when you try to broaden the picture, every city, large or small, generates its own sizable amount of trash. Think how much trash a place like New York must create on a daily basis. Enough to fill hundreds, if not thousands, of warehouses like the kind I described above. Go bigger and think of the trash generated by entire countries, or entire continents. All the oceans of garbage and waste flowing out from our daily activity. And this happens every single moment, every single week, every single month, every single year. It's truly mind boggling. How we're not somehow buried in it up to our necks by now is astonishing. I'm reminded of a joke by Bill Burr, when he remarks on the highly accurate, but not often thought about fact, that everything we've ever used is somewhere. Think about your entire life and everything you've ever donated or thrown away. All that stuff is somewhere out there. Crushed beneath a landfill, or floating out in the ocean, or, just maybe, is being used by someone else. It's crazy to think about, isn't it? The history of people's trash. Those both alive and dead have all left their mark in this way. I can't help, but notice how in every single house, down every single street, and in every obscure little corner of human habitation; people are using things, throwing things away, buying new things, gobbling up electricity to heat their homes in the winter or cool them in the summer, ordering take-out, driving their cars, making plans for international trips which involve air travel, or other things they'd like to do which requires enormous fossil fuel energy. In every major city, at every single moment of the day, people go to stores, they shop, they dine out, they go to the movies, they mingle at nightclubs, they go to amusements parks and take in all the lurid sights they can. And all this happens. Every. Single. Day. Year upon year. I mean, just think of how this already has happened for decades now. From Chicago, to Tokyo, to Melbourne, to Toronto. Every single day. Every single night. How in the hell has it managed to go on for this long? With that much energy and resources being used by so many people, in so many places. By rights, it should have all collapsed within a week, yet it's been chugging along for decades now without stopping. Quite the opposite, it's only grown and grown. It makes me realize just how much there is in nature. How much energy to be exploited, how many animals there are to be slaughtered, how many other resources there are to be extracted. And that, as of now, we've squeezed and consumed every last drop out of it. Resources that could have lasted centuries, if not millennia, assuming they were properly managed, with far less people around to need them in the first place (at least less than a billion). Instead, we've taken all of it and stuffed into every belching furnace we could, simply to keep the infernal engine running. Hotels, restaurants, high price getaway resorts, luxury cruises, casinos, and whatever other bullshit you can think of. All so as to keep the lights on and the music booming in every single city across the world, and doubly so for the major ones. Like I said, it's just staggering to me that it's all lasted this long. For better or worse, the world is unknown to me. In my case, I've been a hermit for nearly 15 years. I've never partied, or traveled, or done anything at all except sit quietly in my room. A tidy and well kept dungeon of near perpetual darkness, with garbage bags and thick cardboard taped over every window, leaving me lost behind my own wall of near perfect isolation. All I can do is sit with myself, stewing in morbid self-attention or mulling over any number of other equally dreary topics. Too much time spent thinking about all the things I'd rather not think about. One such common thought would be whether or not anything else will ever make itself known to me, or if all that I've come to realize is all there will ever be. Perhaps hedonism is really all there is. Perhaps matters of pleasure, for whatever form that might take for each individual, really are the only point to life. Sometimes I wonder that, if the world is going to die anyway, you might as well get drunk and party like there's no tomorrow and experience as much as you can before it's gone. If this is true, as I sometimes think to myself, then I suppose I've truly failed in my life. I haven't enjoyed myself and I have nothing, even on the most base level, that could warrant my time spent rotting on this planet. No good memories, no traveling anywhere, no having unique experiences. I've been as good as dead from the day I was born. Everything I've seen outside my window or through my computer screen, might as well be like pictures in a book. A faint two dimensional shadow of something that can never be anything more than what it is. Resting in my imagination only, but not even passing as a figment of the real thing. I'm a pale imitation of life. One that wishes I could have at least gotten something out of all this, as bad as it is, despite knowing in my heart that I never will. ADDITIONAL EDIT BELOW: Thanks for all the info. I hadn't considered some of what was mentioned here and it's given me more to think about. The world is, indeed, a large place and thus affords a copious amount of room for our trash. I'll admit that I wasn't aware of how efficiently garbage can, sometimes, be disposed of. Then again, in a world where a large amount of the air, food, water, and earth is poisoned, I suppose it doesn't much matter in the end how much or how little garbage it is that we actually generate. Well, like I said, it's still staggering to me how long this has gone on for. Consumerism, starting from 1945 and onwards, has been around for a little over 75 years now and, with it, most of our modern conveniences. That's nothing when compared against the rest of human history, let alone the deep time of the natural world, but I don't know. Like I said, it's dubiously amazing to me that it all even lasted a month. The fact that our current arrangements can last longer than a week at most, is even more dubiously amazing. As for myself, I've accepted my lot in life. For what little that amounts to, I suppose. Not everyone has a taste for life, or is cut out for actually living as one would ordinarily expect. It's a sad thing, but as long as humans have been around for, there have been people like me who have puttered about in their dreary existences. Those who've just sort of trudged through life carried by their own prior inertia and fear of death. Tens of millions have come and gone who have found themselves in this predicament and, to this day, there are still those condemned to do the same. I'm just another regrettable example of it. It's not fine, but I accept it. I am what I am and, for better or worse, no one should deny who it is they truly are. Even if who they are only brings them pain and puts them apart from nearly every living thing on the planet. That's how it is, but I guess it doesn't stop me from complaining about it, as I've unfortunately done here, so apologies for that. If there are self-made purgatories, then we all have to live in them. Mine can be no worse than someone else's. Also, for what it's worth, I'm actually a pretty healthy individual. I engage in at-home exercises, have an extremely clean diet, and take Vitamin D and pro-biotic supplements. I do the laundry, I keep my room exceptionally clean, and, along with my mother, I keep our home well kept and decent. Believe it or not, but these are all things I've done for many years now. And you know what? I still feel the way it is I feel. Garbage bags over the windows and everything. Last year, as a matter of fact, I did enough work around this house to have kept at least 3 separate contractors busy for weeks, but, at the end of the day, I was still left with what I otherwise was. I operated a jackhammer and single-handedly cleared away tonnes and tonnes of old concrete that had been blighting our property for years, only to then do the back breaking work of disposing of it as well. I painted our entire fence, I painted and re-sanded our old deck, and I cleaned up the basement, the garage and the shed from top to bottom. It's partly thanks to what I did that we have a brand new driveway now, since I got the ball rolling on it and significantly reduced the cost through my efforts. But, in the end, I didn't do these things because I was ever asked to do them, but to silence the madness in my mind and to briefly make an escape from my isolation. I didn't have to do these things, but I needed to all the same. Anything to make the pain inside my heart/mind stop, if only for a little while. Like modern media before I was stricken with anhedonia, these tasks were essentially a form of escapism for me. An escapism used to briefly evade experiencing my own empty existence. I don't know what's wrong with me, but, whatever it is, it's been with me all my life. Aside from my mother, and occasionally my older brother when he comes to visit, I speak with no one. I have no friends and, frankly, I have no idea how to make them. This is as true for the digital world, as it is for the flesh and blood one. I don't know what to do about whatever it is I am, but, as hard as it's been, I've tried to accept that this might just be who I was always destined to be. Plus, it's been so many years now. So many years of this. You fall down a hole long enough and, sooner or later, you can't imagine any other way to be. Well, again, it'd just been nice to get something out of all this, this whole civilization thing, besides just being a hermit. I guess in the age of COVID, that's what everyone's encouraged to be anyway. It's like Junji Ito's Army of One made manifest. Who'd have ever thought.

Election shenanigans

According to experts, Trump’s conduct has potential criminal exposure:
A federal statute makes it a crime when one “knowingly and willfully … attempts to deprive or defraud the residents of a State of a fair and impartially conducted election process, by … the procurement, casting, or tabulation of ballots that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held.” A Georgia statute similarly provides that a “person commits the offense of criminal solicitation to commit election fraud in the first degree when, with intent that another person engage in conduct constituting a felony under this article, he or she solicits, requests, commands, importunes, or otherwise attempts to cause the other person to engage in such conduct.” …The hard part for prosecutors would be proving Trump’s state of mind, because the statutes require proof of knowledge and intent. Prosecutors would have to show that Trump knew that Biden fairly won the election, and Trump was asking for Georgia officials to commit election fraud. And it’s not clear prosecutors could make that case.
At least 12 Republican senators plan to challenge Biden’s Electoral College win on Jan. 6, when Congress is set to officially count the votes. The effort is being led by Sen. Ted Cruz (R-Tex.) and includes Sens. Ron Johnson (R-Wis.), James Lankford (R-Okla.), Steve Daines (R-Mont.), John Kennedy (R-La.), Marsha Blackburn (R-Tenn.), and Mike Braun (R-Ind.), as well as new Senators Cynthia Lummis (R-Wyo.), Roger Marshall (R-Kan.), Bill Hagerty (R-Tenn.), and Tommy Tuberville (R-Ala.). Separately, Sen. Josh Hawley (R-Missouri) is pursuing a similar plan.
"Congress should immediately appoint an Electoral Commission, with full investigatory and fact-finding authority, to conduct an emergency 10-day audit of the election returns in the disputed states. Once completed, individual states would evaluate the Commission’s findings and could convene a special legislative session to certify a change in their vote, if needed," the senators said in a joint statement. “Accordingly, we intend to vote on Jan. 6 to reject the electors from disputed states as not ‘regularly given’ and ‘lawfully certified’ (the statutory requisite), unless and until that emergency 10-day audit is completed."
Their plan is not going to succeed in preventing Biden from taking office, as majorities in both the House and the Senate would need to support a challenge against a state’s electoral votes. For an objection to be made, at least one member of both the House and Senate would need to submit it in writing. Then, the House and Senate separately convene to consider the issue. Debate is limited to two hours for each objection. After debate concludes, the House and Senate vote to uphold the objection and throw out the state’s votes. If the majority of the House AND the majority of the Senate does not uphold the objection, the state’s electoral votes are counted as cast.
Vice President Mike Pence’s role is simply to preside over the joint session, opening and presenting the certifications from each state. In his absence, the Senate pro-tempore Sen. Chuck Grassley (R-Iowa) will lead the session. At the end of the process, the presiding officer announces who has won the majority of votes for president and vice president.
The most immediate danger from Trump and Cruz’s doomed election gambit is rightwing terrorism and general violence: Trump, in particular, is inciting his supporters to swarm D.C. on Jan. 6. “JANUARY SIXTH, SEE YOU IN DC!” Trump tweeted last week. Four rightwing rallies are scheduled, including one headlined by George Papadopoulos and Roger Stone. The Proud Boys and other extremists are planning to attend the rallies and may set up an “armed encampment” on the National Mall, according to the Washington Post. On social media platform Parler, the leader of the Proud Boys said that members will be there “incognito” and may “dress in all black” to impersonate leftwing protestors.
Enrique Tarrio: "The ProudBoys will turn out in record numbers on Jan 6th but this time with a twist...We will not be wearing our traditional Black and Yellow. We will be incognito and we will spread across downtown DC in smaller teams."
Rep. Louie Gohmert has more explicitly tried to incite violence, saying the failure of his legal challenge to the election means “you gotta go the streets and be as violent as Antifa and BLM.” (clip)
At the same time, pro-Trump lawyer Lin Wood suggested that Pence could “face execution by firing squad” for “treason” if he doesn’t go along with the attempt to subvert the election.
Obstructing the transition
Biden’s transition director has accused the Office of Management and Budget of stonewalling the incoming administration’s team. OMB Director Russ Vought is not allowing key staff to meet with the transition team to help prepare the president-elect’s first annual spending plan, a move that could delay major proposals. Vought pushed back on the charges, saying that his agency needs to focus on finalizing the Trump administration’s regulations before the president leaves office.
“OMB leadership’s refusal to fully cooperate impairs our ability to identify opportunities to maximize the relief going out to Americans during the pandemic, and it leaves us in the dark as it relates to Covid-related expenditures and critical gaps,” [Biden transition Exec. Dir. Yohannes] Abraham said.
Earlier last week, Biden himself said Trump officials are not cooperating with his team, singling out the Defense Department for obstructing information on crucial national security issues. “Right now, we just aren’t getting all the information that we need from the outgoing administration in key national security areas. It’s nothing short, in my view, of irresponsibility,” Biden said. The Defense Dept. finally scheduled meetings with the incoming team this week, after not briefing the transition for weeks.
The timing of the resumption in meetings is notable because it comes after the one year anniversary of the U.S. assassination of Iranian Maj. Gen. Qassem Soleimani on Jan. 3. NATO officials are reportedly worried about the lack of coordination from the Trump administration: "We need the incoming Biden administration to be fully briefed and ready to deal with these very dangerous issues facing NATO's security."
Sabotaging the Biden Administration
U.S. Agency for Global Media CEO Michael Pack is taking steps to keep control of Radio Free Europe and Radio Free Asia during the Biden administration. As chairman of the boards of Radio Free Europe and Asia, Pack and his fellow members have added binding contractual agreements that will make it impossible to remove him or other pro-Trump allies from the board in the next two years.
In other words, although President-elect Joe Biden has already signaled he intends to replace Pack as CEO of the parent agency soon after taking office in January, Pack would maintain a significant degree of control over the networks.
The State Department is likely to designate Cuba as a state sponsor of terrorism “as an 11th hour effort to create hurdles for the incoming Biden administration.” The label, which requires the approval of Secretary of State Mike Pompeo, would undo a major accomplishment of the Obama administration. To take Cuba back off the list, the Biden team would need to conduct a formal review, a process that might take several months.
Such a designation would impose restrictions on US foreign assistance, a ban on defense exports and sales, certain controls over exports and various financial restrictions. It would also result in penalization against any persons and countries engaging in certain trade activities with Cuba.
The Trump administration has been rushing to finalize a myriad of rules before Biden’s inauguration. Since Election Day, the Trump administration has issued about three to four times as many new regulations as it did during other periods of Trump’s presidency. Rules that haven’t been finalized or taken effect can be suspended by an incoming president, which Biden has said he intends to do. By contrast, rules that are finalized can take months, or even years, to undo.
“As a general rule, it takes at least as much process to undo or modify a rule as it does to put the rule in place,” said Jonathan H. Adler, a professor and an administrative law expert at Case Western Reserve University School of Law. “The Trump administration is magnifying that challenge for the Biden administration.”
Trump loyalists are urging the president to stymie Biden’s efforts to rejoin the Paris climate agreement and the Iran nuclear deal. Sens. Ted Cruz and Lindsey Graham are working to get the agreements submitted to the Senate for ratification, requiring a two-thirds vote, with the goal of failure. While such an outcome wouldn’t prevent Biden from rejoining the accords, Cruz and Graham hope it would make their resurrection more problematic.
A vote against them would signal GOP opposition to the world and, they hope, undermine any unilateral action by Biden to rejoin the agreements. One senior congressional aide told RCP that sending them to die in the Senate “would be the final nail in the coffin.”

Trump money and properties
Manhattan District Attorney Cyrus Vance is employing forensic accounting specialists to examine Trump’s finances and business operations. Vance is looking “for anomalies among a variety of property deals” and trying to determine “whether the president’s company manipulated the value of certain assets to obtain favorable interest rates and tax breaks”.
The analysts hired by Vance probably have already reviewed various bank and mortgage records obtained from Trump’s company as part of the ongoing grand jury investigation, and they could be called on to testify about their findings should the district attorney eventually bring criminal charges
In yet another shady business deal connected to Trump, the United States sold the ambassador’s residence in Israel for more than $67 million. The person who bought the residence is none other than Trump mega-donor Sheldon Adelson. The property only became available due to Trump's controversial decision to relocate the U.S. Embassy from Tel Aviv to contested Jerusalem. Furthermore, State Dept. representatives reportedly lied to Congress about the sale, perhaps to hide that Adelson purposefully overbid.
For now, there is no alternative residence for the ambassador, David Friedman, Trump’s former lawyer, who currently uses a suite at Jerusalem’s King David Hotel or rooms at the former Jerusalem Consulate General when he spends nights in Jerusalem… As a result, the United States appears likely to end up leasing the residence it has owned since 1964 from the GOP-affiliated casino mogul. “It is very strange that we are now paying Sheldon Adelson,” a congressional aide told The Daily Beast. “It is not above board. We have a number of questions. Did they get two independent appraisals? Was it a sweetheart deal? Was Adelson the highest donor? Was there a reason to sell it now?”
Trump’s businesses have taken in $10.5 million of donor money over the course of his presidency. $8.5 million came from the Trump campaign and related entities that Trump controls directly; $2 million came from other Republican candidates and committees. The biggest beneficiary was Trump’s NYC hotel, taking in $3,039,979 over the four years of his presidency, with $891,003 of that in just the final four months of the campaign. Trump’s DC hotel is ramping up room prices and requiring a two-night minimum stay for two key events this month, as the president tries to squeeze more profit out of his office. On Jan. 6, when Congress is set to formally count the votes cast by the Electoral College, room rates are listed at over eight times the price of surrounding dates. Trump is encouraging his supporters to attend a protest of Biden’s win on the 6th. A room during the inauguration costs five times the normal rate, at $2,225 per night. Trump’s Turnberry Resort in Scotland posted a £2.3 million ($3.1 million) loss in 2019, marking the sixth year in a row it has failed to turn a profit under his ownership. Since Trump took over the historic property in 2014, its losses now total nearly £45 million ($61.5 million).
The fact Turnberry remains in the red comes in spite of significant tranches of payments it has received from the US government during Mr Trump’s single term in office… the US Secret Service spent nearly £25,000 to accommodate its agents at the resort during business trips by Mr Trump’s son, Eric, an executive vice-president of the family firm. Since Mr Trump’s election, the property has received close to £300,000 from the Secret Service, US State Department, and US Defence Department
A Florida state lawmaker is calling for Mar-a-Lago to be penalized - and possibly shut down - for flouting coronavirus restrictions during a New Years Eve party. While Trump and the first lady did not attend, son Don Jr., attorney Rudy Giuliani, Rep. Matt Gaetz, and Fox News personality Jeanine Piro were captured on video among the maskless crowd. Guests paid as much as $1,000 for access to the ballroom to be entertained by Vanilla Ice.

Are you ready for a Donald J. Trump Airport? According to the Daily Beast, Trump has been asking aides about the process of naming airports after former U.S. presidents. Further reading: “Jared Kushner’s family real estate business wants to raise at least $100 million in capital through Israel’s bond market… Kushner has helped spearhead a series of moves that have been applauded by the conservative pro-Israel community, including moving the U.S. Embassy to Jerusalem from Tel Aviv and recognizing Israeli sovereignty in disputed areas such as the Golan Heights. Kushner also has close ties to Israel’s prime minister, Benjamin Netanyahu.”

The Census Bureau missed it’s end-of-year deadline to produce numbers that determine representation in Congress and the Electoral College for the next decade. The agency is working toward Jan. 9 as an internal target date for completing the current stage of processing records. "If we miss Jan. 9, it's hard to envision that we would get apportionment done before inauguration," a Census employee told NPR.
The final timing of the 2020 census results' release could undermine President Trump's efforts to make an unprecedented change to who is counted in key census numbers before leaving office… If the first census results are not ready until after Trump's term ends on Jan. 20, it would be President-elect Joe Biden, not Trump, who would get control of the numbers, which are ultimately handed off to Congress for certification.
Who killed notorious 1940s gangster Benjamin ‘Bugsy’ Siegel, the father of modern Las Vegas? Was it another mob boss? The lover of his best friend's wife? One of the men he was embezzling money from? His Mafia spy girlfriend? His own bosses? The possibilities are endless—and puzzling.
(Note: be warned, kind of long background info here, but I think it’s needed) As far as interesting lives, few can beat Benjamin ‘Bugsy’ Siegel. Born February 28, 1906 in Brooklyn, New York, Siegel came from a poor Jewish family. Before he was even twenty, he’d established a profitable protection racket and a lengthy rap sheet, including armed robbery, rape, and murder. Siegel had connections—he was childhood friends with Al Capone and familiar with many of the well known New York City mobsters of the day—and he also had a taste for violence. Soon, he’d established a small mob specializing in hits for the numerous bootleg gangs of the time with Meyer Lansky, a fellow mobster. His violence and short temper led some to say he was “crazy as a bedbug,” giving him his famous nickname ‘Bugsy,’ which he even more famously despised. Siegel was making money, which he was happy to flaunt, but he wanted more. He carried out several hits for Charles “Lucky” Luciano, and eventually formed Murder Inc. with his associates, establishing himself as a skilled hitman for the National Crime Syndicate, an organization of mob families. But Siegel was already making enemies, and several assassination attempts were made on his life, some of which came very close to being successful. So, it was time to move out west. In California, Siegel helped establish gambling rackets, drug trade routes, and prostitution rings. His star was rising outside of the Underworld too, and in addition to the numerous politicians and police on his payroll, he befriended stars like Cary Grant and Clark Gable. Incredibly, while in Italy with a socialite in 1938, he met Hermann Goering and Joseph Goebbels, whom he immediately disliked and offered to kill. The offer was declined by his lady friend. Yet Siegel was not always looked upon fondly by the upper echelons of Hollywood; he borrowed exorbitantly from celebrities, knowing he would never be asked to pay it back, and began to develop extensive plans to extort movie studios. After several trials and acquittals for failed and successful hits, it was time to leave California. Siegel’s next stop was Las Vegas where, in 1945, he purchased and developed the Flamingo Hotel & Casino, the first luxury hotel on the Vegas strip. As you might imagine, that was expensive, and over the course of its construction, costs were equivalent to over $61 million in today’s money each year. Siegel’s checks were bouncing, and many of the locals felt threatened by him. Mob bosses were beginning to lose patience with Siegel too, and he was refusing to report on business, claiming he was running the California Syndicate himself. For now, they left him alone—he'd been valuable in the past, after all. The Flamingo Hotel was a dismal failure, and people—very powerful people—were starting to get tired of waiting for the promised money to materialize. By 1947, it was gradually turning around—with the help of Meyer Lansky, now in Vegas—but for most, it was too little too late. Death: On June 20, 1947, Siegel was gunned down in the Beverly Hills home of his sometimes-girlfriend Virginia Hill. He was 41. Somewhat suspiciously, Hill had taken an unscheduled flight to Paris the day (or by some sources, week) before. As Siegel sat reading the newspaper with associate Allen Smiley, an unknown assailant fired with a .30 caliber military M1 carbine through the window, striking Siegel many times (NSFW). Two shots hit his head, with one passing through his right cheek and the other his nose. Though he was not hit directly through the eye (NSFW), a bullet-in-the-eye death became a popular trope in Mafia media, including in the Godfather, where a character based on Siegel is murdered in the same manner. The death was covered extensively in the media, which portrayed Vegas as a bastion of sin and mafia activity. As early as the day after Siegel’s death (or, as some sources have it, during Siegel’s death), however, more personal things were changing: Lansky walked into the Flamingo and took over operations. Theories: The mob is famously tight-lipped, and Siegel’s death was no exception. Despite the extensive speculation, no precise motive has ever been confirmed. There was a massive police investigation, but in a case like this, that doesn’t mean much, nor does the media coverage. The media in particular salivated over the potential for splashy crime stories, and the circumstances of this case have been complicated by contemporary coverage. Several days after Siegel’s death, for example, one newspaper ran the headline “BUGSY'S BLONDE EX-WIFE GIVES CLUES TO HIS KILLERS,” while another read “BUGSY'S EX NO AID IN HUNT.” As far as the most popular theories: A Mob hit: A mob hit seems like the most obvious cause, and it's a theory that’s been popularized by several novels and the 1991 movie Bugsy. It would certainly make sense; it was the mob’s money Siegel had been spending wildly on his unsuccessful hotel after all, and he’d been growing uncooperative. Of the proposed hitmen, the most often mentioned are Frankie Carbo (Ralph Natale, former Philadelphia boss and Mob squealer, claimed Carbo as the true killer) and Eddie Cannizarro, both Syndicate hitmen. But even here, there are several proposed reasons for the hit. As some have it, mob money from the Flamingo’s funding was going missing and Siegel was skimming off the already meager profits. Skimming could have been forgiven, if the Flamingo was a success. It was not. After a meeting of the Syndicate’s “Board of Directors,” it was allegedly decided that Siegel would die, with Lansky reluctantly agreeing. Others believe that a hit might have been ordered whether Siegel was skimming or not; the Flamingo was simply too expensive. As one historian put it, “Bugsy was a dreamer. And he was dreaming with other people’s money.” Yet many have also argued against this theory. According to one of Siegel’s emissaries in Vegas, for example, no one would have dared to order a hit on Siegel. He and Lansky were close until the end of their lives, and Lansky would never have agreed to it. And if Lansky would not agree, then Charles “Lucky” Luciano, who was “the head of everything,” would never have agreed either. And as others have argued, the method of execution (NSFW) didn’t match with typical mob methods; firing a weapon from outside a house increased the risk of missing as well as the risk of being seen. The preferred method was a clean shot to the back of the head. According to some, the oft-referenced money problems of the Flamingo also wasn’t an issue. At the time, Lansky was paying back any investor who wanted out, and the gradual uptick in its profits was quickening by the day. Personally, I don’t think the financial uptick invalidates the theory. If the hotel was starting to make more money, then that might be all the more reason to get rid of the difficult-to-manage Siegel and take over. Wire Business: At the time of his death, Siegel was embroiled in a dispute with Jack Dragna, dubbed the Capone of Los Angeles. Siegel and Dragna had had an uneasy partnership in previous years, but Dragna, far less powerful than Siegel and the New York gangs, resented the income and respect Siegel commanded. This came to a head when a racing wire service (a way of cheating on bets) between the two of them soured. Siegel wanted control for himself, and ordered Dragna to turn it over or be killed, to which Dragna agreed. After Siegel’s death, control was returned to Dragna. He had a motive, but his story would only have been one among many for a man as ruthless as Siegel, which, in a way, complicates things further—there’s a real possibility that the culprit in Siegel’s murder was someone never even considered. His list of enemies was long, varied, and probably mostly unknown. Yet another man who had reason to want Siegel dead, for example, was his bodyguard and muscle Mickey Cohen. A Cleveland gangster, Cohen was given control of the Syndicate’s West Coast gambling operations. If Siegel still lived, he would never have gotten it. Interestingly, he, like Al Capone before him, was eventually felled by tax evasion. Virginia and/or brother: The same emissary of Siegel who shot down the mob hit theory believed that Virginia Hill’s brother had carried out the murder. The brother, a marine stationed at Camp Pendleton named Bob or Bill, had seen Siegel and Virginia fighting outside the Flamingo as well as the bruises Siegel had left on her and threatened to kill him. Another of Virginia’s brothers, Chuck, was also at the Beverly Hills house when Siegel was murdered. Virginia herself has also been the subject of suspicion. Nicknamed the “Queen of the Mob,” Hill worked, among other powerful jobs, as a cash courier, laundering money and stolen goods as well as blackmailing high-ranking men through sexual liaisons. Her relationship with Siegel was tempestuous at best, and she may have been embezzling from the Flamingo. She’s also been accused of two-timing with rival mob operations, though this is unconfirmed. Eventually fleeing to Europe permanently, Hill died of an overdose in 1966, though some have alleged that she was actually murdered after she, completely broke, attempted to leverage her intimate knowledge of the Mob. Rival Mobs: Unfortunately, I can’t find much concrete information about this theory (note: story of my life researching these posts haha), but some believe that rival mob operatives wanted Siegel gone. He was a powerful—and very public—figure, which made him something of an obvious target in the cut-throat world of Mafia politics. Moe Sedway: This is a relatively new theory, emerging after Robbie Sedway was interviewed for LA Magazine after his mother’s death. Here, he alleged that Siegel’s murder was ordered by his mother Bee, the wife of powerful mobster—and childhood friend of Siegel’s—Moe Sedway. According to Bee, who wrote and scrapped a book proposal called Bugsy's Little Lunatic (Siegel’s nickname for her), Siegel had threatened her husband, who was the Flamingo’s numbers man, and therefore watching Siegel—who, remember, had been accused of skimming—closely. So Bee contacted Mathew “Moose” Pandza, a truck driver whom Bee married after Moe’s death. Moose, the perfect killer, since he had no connection to the Mob, then shot Siegel to death. The problem with this theory, however, is that Bee is the only source; as she herself said, anyone who could contradict her was dead. She also squandered most of the fortune left to her by Moe over the course of her life, and died almost penniless. All of the above: Some believe that almost all the suspects were involved. Usually, it goes something like this: “Virginia supplied the location and received some reward. Cohen knew Bugsy's schedule for the evening, but happened to not be watching him that night…Dragna ordered the hit, with the approval of Lansky and Luciano.” It’s unlikely, but it certainly has its believers, if only for the convenience of it. Final Thoughts & Questions: This case is interesting to me because of the sheer number of suspects. In the end, a mob hit seems the simplest and most likely explanation. But there were so many people with means, motive, and opportunity. So:

Kai Bickle's world came tumbling down one night in May 2019, when he attended a dinner party at a lavishly decorated mansion overlooking the golden sands of Venice Beach in Los Angeles. The host was his father, Peter Nygard, a Canadian fashion tycoon famed for the hedonistic lifestyle he pursued at a global portfolio of high-end properties, including vast residences in Winnipeg, Toronto and Montreal, as well as New York, and, most notoriously, a Mayan-themed 'private luxury resort' in the Bahamas. Modelling himself on Playboy founder Hugh Hefner, the flamboyant Nygard, now 79, kept a revolving harem of girlfriends. Those caught up (often completely unwittingly) in this web had included actresses Susan Anton and Jennifer O'Neill, stripper-turned-reality star Anna Nicole Smith, and a former Wheel Of Fortune card turner by the name of Vanna White. His Caribbean parties, meanwhile, tended to attract a better class of A-lister. Past visitors to the island property had ranged from Jane Seymour and Bo Derek to Robert De Niro, , Michael Jackson and Joan Collins, not to mention and , who were photographed there in the early 2000s on an innocuous family holiday. The 2019 bash, during one of Peter's occasional business trips to LA, was to be a more down-to-earth affair. Roughly 20 guests, including Kai, 38, and his younger brother Jessar (one of roughly ten offspring Nygard has fathered via more than seven women) had been invited for food and drinks, followed by a late-night poker game. That was the plan, at least. But Kai never made it to the card- table. Instead, he fled the lavish premises in a state of distress, shortly after dinner, believing that he had just witnessed his father attempting to sexually assault an eight-year-old girl. Details of this ugly development are (it should be stressed) strongly disputed, and we shall examine them later. But the incident would kick-start an extraordinary chain of events that culminated just before Christmas, with the arrest of Peter Nygard on nine charges of sex trafficking and racketeering. Currently behind bars, with his $900 million (£660 million) business empire in tatters and the FBI poring over his computer hard-drives, the fallen tycoon has now been accused of rape or sexual assault by at least 57 women. Several of Nygard's accusers were children when the alleged crimes took place, and many claim they were drugged. At least 57 women have accused him. He will appear in court in Canada next week, seeking bail as he fights extradition to the USA. It is, perhaps, the most high-profile and shocking sex case since handcuffs were slapped on Jeffrey Epstein. And in a remarkable twist, it turns out that a leading figure in the increasingly public campaign to prosecute Mr Nygard is his aforementioned son, Kai. Upcoming documentary: ‘Unseamly’ Canadian Designer Peter Nygård True Crime Documentary Behind the scenes, I can reveal that Kai has spent the past 18 months secretly helping both the U.S. and Canadian authorities investigate his own father's alleged crimes. Keeping his role hidden from Nygard and his associates for several months, he has worked tirelessly to assist victims, and their legal teams. On the personal front, he has changed his name (taking up his mother's surname to become Kai Zen Bickle) and used his influence over various Nygard companies to block efforts to move his assets offshore, fearing that would allow him to flee. 'We have been engaged in a brutal battle against my father and his enablers,' is how Kai summed things up when we spoke this week. 'He has become my arch-nemesis. I no longer regard him as my father . . . He is a monster. I am now here to serve in any way I can, to support survivors and the justice process and also to help expose the people who covered up his crimes.' Perhaps most remarkably of all, Kai recently helped two of his younger siblings, one of whom remains a minor, to sue Peter Nygard over claims he 'engineered' the rape of his own sons. In an extraordinary lawsuit filed in August, the boys claimed that their leathery, multi-millionaire father instructed one of his long-standing girlfriends (who was also a sex worker) to 'make a man' out of them. The first of these alleged attacks (which, again, are vehemently denied by Nygard) took place in the Bahamas 2004, when the son was 15 and the woman was in her mid-20s. The second occurred in Winnipeg in 2018, when the younger child was 14 and the woman was in her 40s. Court papers filed by the boys stated that the unnamed girlfriend was instructed to seduce Nygard's son by showering in his bathroom so that he 'could see her naked'. Then she raped him. Afterwards, she allegedly told the boy he 'wasn't bad' for a 'baby.' The next morning, Nygard's girlfriend brought him breakfast in bed, kissing him on the lips and announcing: 'Mommy's got you.' Kai says he first became aware of this appalling incident last spring, and was 'sickened' to hear his brothers' claims. He would often yell and scream at his staff. 'We all spoke and decided the best course of action was to file a lawsuit publicly in the hope that other survivors would feel safe to come forward and also file criminally against Nygard,' he says. 'We were originally going to have me in the suit as my young brother's guardian, but in the end decided not to because it would reveal to Nygard that I was working against him . . . At the time I was [secretly] doing everything I could to improve the odds that he would get arrested.' To appreciate the extraordinary journey taken by Kai, we must wind the clock back to the mid-1980s, when his father was one of Canada's most talked-about self-made millionaires. The son of penniless immigrants from Finland, Peter Nygard had launched his empire in the late 1960s, with an $8,000 (£6,000) investment in a struggling fashion firm. By the time he was 30, the company had become one of North America's most successful suppliers of leisure and sportswear, while his flamboyant eccentricities, which included keeping parrots in his office and filling the lobby of Nygard HQ with bronze busts of himself, turned him into an object of public fascination. In 1987, the party-loving entrepreneur purchased a 4.5-acre patch of the island of New Providence in the Bahamas and set about turning it into a 'dream home' where he could indulge his champagne lifestyle. Over the ensuing years, he built 150,000 sq ft of Mayan-themed buildings, stretching over a dozen 'cabana-style' residences. The buildings at Nygard Cay eventually included a casino, a disco hut (with cameras beneath the dance floor, reportedly to shoot images of revellers from below), and the world's largest sauna, a 6,000 sq ft lodge made from 2ft-thick Canadian pine logs. In the grounds were fake volcanoes that belched dry ice, a flock of peacocks, stone cobras which hissed steam at sunset, 60 ft towers festooned with hundreds of flaming torches (lit nightly by staff) and giant statues of nude women, purportedly modelled on some of Nygard's favourite girlfriends. At weekends, he would host lavish parties, which appeared on various TV documentaries, including Lifestyles Of The Rich And Famous. The place became a magnet for freeloading celebrities and, while Kai believes they generally had the most fleeting and brief relationship with Nygard, photos of their visits were then plastered across company literature and websites. Prince Andrew, to cite one example, was recorded for posterity wandering with the long-haired fashion magnate on the beach, wearing blue shorts and boat shoes. Born in the 1980s, Kai spent the first three years of his life in the Bahamas until his mother, Patricia, left Nygard, with whom she'd had three children but never married. They moved first to California and then to the Pacific Northwest in the U.S. Over subsequent years, he had almost no regular contact with the fashion tycoon aside from occasional visits during school holidays, where he met various half-siblings. 'He would have one family weekend per year at his lake cottage, and a few days set aside for Christmas,' says Kai of the somewhat unorthodox arrangement. 'During those times, the days were filled with activities like horseback riding or mini golf. 'He could be a very charismatic person when he wanted to be and the family weekends were very light and brief.' In the very limited time he spent with his father during childhood, Kai saw nothing that gave him reason to suspect that Peter Nygard was guilty of criminality, though he did have a highly volatile personality. 'He would yell and scream at his staff often, and that always was upsetting to everyone around it, but he would describe his yelling as 'passion' because of his 'high standards',' Kai says. Nygard's children were further told that he 'lived a consensual, non-monogamous lifestyle,' Kai says. 'He made speeches at dinner to family when we were together to talk about how he hoped everyone got a wonderful partner and wished that he could find that special someone, but that it wasn't the life for him. 'He also had girlfriends that were persistently with him, always two or three, and often they were around for years. He wasn't embarrassed about it. He flaunted it on TV, it was part of his brand, something he showed the whole world. He was proud of it.' Be that as it may, rumours of predatory behaviour by Nygard —and worse — had occasionally reared their ugly head, only to be quickly suppressed: a relatively easy task before the internet. In 1980, for example, he was charged with the rape of an 18-year-old, but the charge was dropped when the complainant refused to testify. In 1996, three female employees meanwhile filed sexual harassment complaints in the Canadian province of Manitoba. It looked like his hand was on her thigh, rubbing. One, a 39-year-old communications manager, said that, when called into Nygard's office, she would 'find him in a state of undress . . . with his hands down the front of his pants, fondling himself.' He settled by giving the women $18,500 (£13,600) and denied any wrongdoing. Then, in 2010, a Canadian TV network put out a Panorama-style documentary about Nygard, focusing on alleged sex abuse and harassment of former employees. It quoted a former stewardess on his private plane who alleged that on one journey — during which Nygard was accompanied by a troupe of topless women — he lost his temper with staff, shouting: 'You are nothing! You are garbage! I am God!' The programme also alleged that Nygard had engaged in 'inappropriate sexual contact' with a young woman who had been brought to his home in 2003 from the Dominican Republic. Nygard denied that either incident had happened, and sued to stop the documentary being broadcast. Fast forward to May 2019, however, and those ugly incidents were largely forgotten. Kai, who was by then in his late 30s, had worked for his father's companies for just over two years after leaving college, but quit to pursue a career in activism and health science. Nygard's trip to Los Angeles afforded them a rare opportunity to catch up, so he attended the aforementioned dinner party in Venice Beach. As the night wore on, he recalls becoming uncomfortable about his father's behaviour towards an eight-year-old girl, who was attending with her mother, one of Nygard's old girlfriends. 'He's got her sitting right next to him at dinner, which is usually his girlfriend chair. And he's a creature of routine. So I'm already thinking this is weird. 'He's trying to act like the Papa. It was just weird . . . I'm noticing things. I'm noticing that he's telling her little secrets at dinner. Putting his hand close to her ear and going all hush-hush.' At the end of dinner, most of the other 20-odd guests got up to adjourn to the card table. However, Kai adds: 'I'm still watching him. Her chair gets pushed back. He brings her round to him. 'She was on his right side. He brings her to his left side, with his arm around her waist, and I see his elbow change and start moving as if — it looked to me, I couldn't see, but it looked like his hand was on her upper thigh, and rubbing. That's what it looked like to me . . . Everything in my body told me he was doing something terrible.' 'I had a huge adrenaline rush and I immediately told the mother to get her daughter away from him,' he adds. 'I stood up next to him and looked in his eyes. At that moment, for me, it was like all the walls were crashing down around him . . . And I realised that, yeah, he's probably trying to groom that girl.' Nygard vigorously denied wrongdoing, and even called Kai 'sick' for thinking as much. But Kai was unconvinced. Then, in February last year, ten women filed a bombshell lawsuit in New York claiming that the fashion magnate had used wealth and status to 'entice underage girls' from 'young, impressionable and often impoverished backgrounds' into his home, where they would be 'plied with alcohol' and (some allege) date-rape drugs, before being taken to Nygard's private quarters, where he would 'assault, rape and sodomise' them. Court papers claimed they were then coerced into joining a globe-trotting harem of sex workers paid thousands of dollars from Nygard's company funds and trafficked around the world on his company's private jet, which reportedly boasts a stripper pole. One alleged victim, who was just 14 at the time, claimed Nygard raped her and paid her $5,000 (£3,700). Another said her encounter with Nygard began with him showing her pornography after which he raped her, 'causing her extraordinary trauma and pain', the suit states. Three of his existing ten accusers were 14 at the time. Three more were 15. Within days, dozens more alleged victims had come forward. By the summer, some 57 survivors were pursuing legal action — and the number of alleged victims had reached 100. Kai again confronted his father, only to be told it was all 'lies' and asked to speak out publicly in his father's support. But days later a friend texted Kai to complain about a recent visit to Nygard's house in Los Angeles. 'He said he'd brought a female friend with him, who had one or two drinks and had started to feel very high. Nygard took her up to his room and aggressively had sex with her, not using a condom. 'When I heard that, I knew he was not only as bad as people said he was, but was a dangerous criminal and had to be stopped.' He duly alerted the authorities about the friend's message. In a podcast called Live To Walk Again, released this week, he revealed that he began helping both the police and the alleged victims' lawyers, who he regards as 'heroes'. Over the summer, Kai also used official positions held in Nygard firms to block two apparent efforts to move assets overseas, amid concerns that the tycoon might flee to evade justice. PODCAST EPISODE: Peter Nygard Discusses His Father 'Through the course of ten months I also helped several survivors to file criminally against him, and spent countless hours on the phone with survivors, lawyers and authorities,' he says. Last month Nygard was arrested on U.S. charges at a home in the Royalwood area of Winnipeg. He spent Christmas behind bars and has consistently denied any wrongdoing, saying he 'expects to be vindicated' in court. Kai has renounced his inheritance and is working on 'making the world a better place' by campaigning to close legal loopholes exploited by sex offenders. 'I'm very happy earning my own money, as I have all my life. We've never had a trust fund or an allowance, and since his money has been made through pain and suffering, I won't accept a potential inheritance,' he says. His father's cash, he says, should instead go towards compensating victims. 'My focus now is to help the healing process.'
But after the ruling, the plaintiffs identified documents - 55 so far - that should have been turned over to them but never were. Last month the court ordered the state to turn over the computers so the plaintiffs could forensically examine them because the judges found "some form of 'fraud, misrepresentation, or misconduct' likely occurred."

Kennedy, who ran the bank’s commercial real-estate team, continued to lend to Trump even though Deutsche clients had suffered severe losses when Trump’s casino business collapsed and he declared bankruptcy.

In the transcript published by the Post, (Kevin) McCarthy speculates that the Russians hacked the Democratic National Committee’s computers and, in the process, discovered whatever opposition-research materials the Democrats had gathered on Trump. “There’s two people I think Putin pays: Rohrabacher and Trump,” (Kevin) McCarthy said, according to Entous, a superb reporter who heard a tape recording of the colloquy. “Swear to God.” In the Post piece, McCarthy’s remark is met with laughter, and Ryan cautions his colleagues, “This is an off the record . . . Background A fond memory of playing games with friends as a kid was Luigi’s Casino. We’d play those stupid chance games all the time and it was so fun. Looking back, I wanted to design a tour around Luigi in his casino costume, so I thought where else a casino was present in Mario games. Of course, I immediately came to Hotel Delfino and the Sunshine version of King Boo. This tour idea is a mishmash these two characters put together. (This tour idea series was inspired by u/WaffleyDootDoot. Please check him out, some of his ideas are great!) New Track Wii Moonview Highway: When choosing the new track, I had two themes in mind; night skies and bustling cities. This track is exactly both of those things and more! Not only do you get to swerve along the city roads, but you also get to take in the amazing views off the side of the highway. This course would also be the second from Mario Kart Wii, taking its place alongside Maple Treeway. New Drivers Luigi (Casino) (Medium, High-End): Luigi turns up in his casino outfit from the Super Mario 64 DS party games! He handles the riches of the casino, as well as acting as a gamemaster. His special item is the Coin Box. King Boo (Sunshine) (Large, High-End): King Boo arrives in his Mario Sunshine style! After hiding under the casino of Hotel Delfino for far too long, he’s more than ready to haunt the race. His special item is the Giant Banana. New Karts Casino Bruiser (High-End): A black and green chequered variant of the normal Bruiser, this ride is sure to match Luigi’s new costume as he goes from riches to races. Its boosted skill is Slipstream Plus. Pepper Pedaller (High-End): A variant of the Banana Master which features a supersize chili pepper. Despite his hatred for spicy food, it does match King Boo’s big, red tongue. Its boosted skill is Rocket Start Plus. Gold Bruiser (High-End): A gold version of the normal Bruiser, this kart is perfect for anyone who wants to express their interest in high fashion. Its boosted skill is Mini-Turbo Plus. New Gliders Spicy Glider (High-End): A red variant of the Tropical Glider; instead of bananas, this tree grows… chili peppers? Its boosted item is the Super Horn. Pipe Spotlights Pipe 1: Luigi (Casino), Casino Bruiser, Fireworks Parachute Pipe 2: King Boo (Sunshine), Pepper Pedaller, Spicy Glider Special Pipe Night Out Pipe: Peach (Vacation), Pauline (Party Time), Rosalina (Aurora), Daisy (Yukata) This pipe celebrates fashion and the lifestyles of those that visit night-time casinos. Peach, Pauline, Rosalina, and Daisy arrive wearing their best outfits! This pipe starts off with 30 items in it. None of the drivers are spotlights and you only pull a maximum of 3 High-End drivers. The USA PATRIOT Act: The Story of an Impulsive Bill that Eviscerated America's Civil Liberties
The USA PATRIOT Act provides a textbook example of how the United States federal government expands its power. An emergency happens, legitimate or otherwise. The media, playing its dutiful role as goad for greater government oversight, demands "something must be done." Government power is massively expanded, with little regard for whether or not what is being done is efficacious, to say nothing of the overall impact on our nation's civil liberties. No goals are posted, because if targets are hit, this would necessitate the ending or scaling back of the program. Instead, the program becomes normalized. There are no questions asked about whether the program is accomplishing what it set out to do. It is now simply a part of American life and there is no going back. The American public largely accepts the USA PATRIOT Act as a part of civic life as immutable, perhaps even more so than the Bill of Rights. However, this act – passed in the dead of night, with little to no oversight, in a panic after the biggest attack on American soil since Pearl Harbor – is not only novel, it is also fundamentally opposed to virtually every principle on which the United States of America was founded. It might not be going anywhere anytime soon, but patriots, liberty lovers and defenders of Constitutional government should nonetheless familiarize themselves with the onerous provisions of this law, which is nothing short of a full-throttle attack on the American republic.
What’s Even in the USA PATRIOT Act?
What is in the USA PATRIOT Act? In the Michael Moore film Fahrenheit 9/11, then Rep. John Conyers cracked wise about how no one had actually read the Act and how this was in fact par for the course with America's laws. Thus, before delving into the deeper issues surrounding the PATRIOT Act, it is worth discussing what the Act actually says. Here’s a brief look at the 10 Titles in the PATRIOT Act:
Title I: Enhancing Domestic Security Against Terrorism: This provision dramatically expands the powers of the President, the military and the intelligence community whenever the specter of "terrorism" is invoked. Bizarrely, it contains a provision condemining discrimination against Arabs, Muslims and South Asians, which seems to have very little to do with protecting Americans from terrorism.
Title II: Enhanced Surveillance Procedures: Title II contains the meat of the Act with regard to massive, industrial-scale surveillance on the American public. Beyond the simple spying on Americans and their communications, Title II increases the ability of federal intelligence agencies to share your private communications with one another.
Title III: International Money Laundering Abatement and Financial Anti-Terrorism Act: Not simply a section of the USA PATRIOT Act, Title III is an Act of Congress in its own right. You might have noticed how much more difficult it is to open a bank account or send a wire transfer after 9/11. You can blame this provision, which shredded banking privacy rights in the United States.
Title IV: Protecting the Border: Other than expanding the number of federal employees (of course), the provision of the USA PATRIOT Act charged with protecting America's borders does little other than point toward paths for future action and study. It is worth noting that the weakest provision of the Act is the only one explicitly authorized by the Constitution -- protecting the border.
Title V: Removing Obstacles to Investigating Terrorism: Title V authorizes bounties for the apprehension of alleged terrorists, broadens government power to conduct DNA analysis, allows for greater data sharing between law enforcement agencies and, perhaps most disturbingly, requires private telecommunication carriers to comply with government requests for electronic communication records whenever requested by the FBI. It also expands the power of the Secret Service to investigate computer fraud.
Title VI: Providing for Victims of Terrorism, Public Safety Officers and Their Families: Perhaps the most innocuous portion of the USA PATRIOT Act, Title VI provides for a victims' fund for victims of terrorism and their families.
Title VII: Increased Information Sharing for Critical Infrastructure Protection: The subtitle of this section of the Act is a rather wordy way of saying that the United States federal government is allowing for law enforcement agencies to share information across jurisdictional boundaries in an easier fashion than was previously legal. To that end, the Bureau of Justice Assistance was given a $50,000,000 budget for 2002 and a whopping $100,000,000 budget for fiscal year 2003.
Title VIII:Strengthening the Criminal Laws Against Terrorism: Title VIII is where the rubber meets the road: What exactly is terrorism, according to the federal government? Unfortunately, this Title does little to clarify what terrorism is, instead focusing on declaring a number of actions (such as attacks on transit) as “terrorism,” regardless of intent.
Title IX: Improved Intelligence: The section subtitled “improved intelligence” largely expands the powers and responsibilities of the Director of Central Intelligence.
Title X: Miscellaneous: When the federal government titles a segment of a law “miscellaneous,” you know it’s going to include everything and the kitchen sink. And so it does: The definition of electronic surveillance, additional funds for the DEA in South and Central Asia, research on biometric scanning systems, a limitation on hazmat licensure and infrastructure protections are all addressed in Title X, which is a catchall for everything the federal government forgot to address in the first nine sections of the law.
Most of the provisions of the USA PATRIOT Act were set to sunset four years after the bill was passed into law. However, the law was extended first by President George W. Bush and then by President Barack H. Obama. The latter is particularly scandalous given that, at least in part, a rejection of the surveillance culture that permeated the Bush Administration was responsible for the election of Obama in 2008.
Passing the USA PATRIOT Act
Next, it’s important to remember the environment in which the USA PATRIOT Act was passed: Post-9/11. It is not the slightest bit of exaggeration to label the environment in which the PATRIOT Act was passed as “hysterical,” nor is “compliant” a misnomer for the Congress of the time. Opposition to the Act was slim and intensive review of one of the most sweeping Acts of Congress in American history was nonexistent. All told, Congress took a whopping six weeks drafting, revising, reviewing and passing the PATRIOT Act. That’s less time than Congress typically spends on totally uncontroversial and routine bills that don’t gut the Fourth Amendment. The final vote found only 66 opponents in the House and one (Wisconsin Democrat Russ Feingold) in the Senate. The entire passage of the PATRIOT Act, from start to finish, took place behind closed doors. There were no committee reports or hearings for opponents to testify, nor did anyone bother to read the bill. “Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism” is the bloated and overwrought full name of the bill, crafted by a 23-year-old Congressional staffer named Chris Cylke. This ridiculous name puts the focus not on the surveillance aspects or the erosion of basic civil liberties enshrined in Western society since the Magna Carta, but on patriotism. At the time of its creation, the messaging was very clear: Real patriots support massive intrusions on civil rights. As President George W. Bush said at the time, “Either you are with us, or you are with the terrorists.” This sentiment very much seemed to apply to American citizens. While the argument that if you have nothing to hide you shouldn’t fear investigation is anathema in a Constitutional republic with regard to citizens, it should be standard operating procedure when it comes to our organs of government. If we cannot expect transparency from the United States Congress – elected officials charged with representing the will of the people and protecting the Constitution – then we certainly can’t expect it anywhere else.
The Unfortunate Growth of the USA PATRIOT Act
It’s no surprise to those in the liberty movement that given an inch, the government (in particular the military-intelligence community) took a mile. Even the nebulous definition of “terrorism,” largely centered around a long litany of acts rather than the motivation behind them, has expanded to include receiving military training from a proscribed organization (without actually committing any terrorist acts or even acts of violence of any stripe) as well as “narcoterrorism” – the latter particularly convenient, as the United States government continues its losing “War on Drugs.” Indeed, in many ways, the War on (Some) Drugs was the template for the War on Terror. Both wars have no defined enemy, no defined terms of victory. Instead, they are waged against a nebulous concept, while enjoying bipartisan support for their ever-expanding budgets. What’s more, it didn’t take long for the Feds to start using the USA PATRIOT Act for things it was never intended for, including prosecuting the War on Drugs. Perhaps the silliest application of the USA PATRIOT Act is the prosecution of Adam McGaughey. McGaughey maintained a fansite for the television seriesStargate SG-1. The Feds charged him with copyright infringement and computer fraud. In the course of their investigation, the FBI leveraged the PATRIOT Act to get financial records from his website’s ISP. This was made possible by the USA PATRIOT Act amending the Computer Fraud and Abuse Act, allowing for search and seizure of ISP records. The New York Timesdiscovered in September 2003, that the USA PATRIOT Act was being used to investigate alleged drug traffickers without what would otherwise be sufficient probable cause. These were investigations into non-terrorist acts using a law ostensibly designed to investigate terrorism. There was some suspicion that the Act was being used to investigate crimes occurring before the Act was passed, violating the ex post facto clause of the United States Constitution. In one of the biggest power grabs (excluding virtually everything we know from Edward Snowden – more on that below), the FBI sent tens of thousands of “national security letters” and procured over one million financial records from targeted businesses in Las Vegas. These businesses were primarily casinos, car rental bureaus and storage spaces. The data obtained included financial records, credit histories, employment records and even people’s personal health records. The FBI maintains and databases this – and, indeed, all information collected through the USA PATRIOT Act – indefinitely. In the good old days before the PATRIOT Act, the Feds were compelled to destroy any evidence they collected on someone later found not guilty of a crime. Note that the aforementioned data collection brought to public attention by Edward Snowden (which, again – we’re getting to that) falls under this provision. Not only is the government collecting obscene amounts of private and personal information about you, they’re also storing it indefinitely with no plans to stop. What’s more, the FBI has approached public libraries to turn over the records for specific terminals, collecting information not about specific users who might be under investigation, but about anyone who has ever used the computer at the public library. Libraries, to their credit, have been very much at the forefront of resistance against the PATRIOT Act, with some litigating compliance despite operating on small budgets and others posting “canary letters,” which effectively say “The FBI Hasn’t Been Here Yet.” The removal of such a letter would warn patrons that the FBI has been sniffing around in their records. Indeed, the greatest criticism of the PATRIOT Act is the simplest and perhaps most obvious: Why does an Act ostensibly passed to fight terrorism so drastically expand the government’s power to investigate virtually everyone else? The PATRIOT Act is not merely unconstitutional, it is an unprecedented expansion of state power in the Anglosphere, a culture based on restricted government and the primacy of individual rights. An excellent example of this is the Foreign Intelligence Surveillance Act (FISA) expansion. Most people are familiar with the term “FISA court,” but very few people actually know what it is – a special federal court created under the Carter Administration that grants approval of electronic surveillance of both citizens and resident aliens in the event that they are accused of acting in the service of a foreign power. The last part of this sentence is very important: The FISA courts are not simply for allowing surveillance of anyone that it might be expedient to collect information about. The scope of their powers is very, very limited. Or was. The PATRIOT Act lowered the burden of evidence required to obtain a FISA warrant for electronic surveillance and expanded the overall scope of the FISA courts. Any savvy federal agent can now drape his charges in the garb of (what else?) “national security” and obtain electronic surveillance privileges hitherto only dreamed of by investigators. FISA courts have become pliant tools in the hands of the Feds, gladly approving their requests to monitor phone and internet surveillance, as well as access to medical, financial and educational records.
The Future of the USA PATRIOT Act
Do we still need the PATRIOT Act? Did we ever? All laws are certainly a product of their times. But this seems much more acutely true of the USA PATRIOT Act, which was passed in a rush and under duress without due consideration. Particularly in light of the revelations from Edward Snowden – that the government is spying on everything they possibly can – it’s worth asking if there’s any walking back. He points out that the police state apparatus was originally for drug dealers, then for terrorists, but ultimately ended up being applied to anyone and everyone. What’s more, Bob Bullard notes another frightful aspect of the USA PATRIOT Act: Terrorism-related cases are not subject to the Freedom of Information Act. This means that there is little or no oversight. There is no surer hallmark of a police state than an all-powerful domestic surveillance agency with no transparency or oversight. While the USA PATRIOT Act might not create an American Stasi as such, it certainly paves the way for one.
